The ‘Hirer’
For the purpose of these Terms and Conditions the ‘Hirer’ refers to any individual, company, corporation, Government body, or other legal entity (including their personal representatives, lawful successors, permitted assigns, or any party legally authorised or required to manage the Hirer’s affairs) that engages in equipment hire, services or personnel from SLV PRODUCTIONS.
Agreeing to Terms and Conditions
By accepting a quotation and proceeding with a booking with SLV PRODUCTIONS, the Hirer expressly acknowledges and agrees to be bound by SLV PRODUCTIONS’ Terms and Conditions. This acceptance constitutes a legally binding agreement between the Hirer and SLV PRODUCTIONS, effective from the date of the booking.
Dry Hires
For dry hires (hires without an SLV PRODUCTIONS Technician) equipment is not covered by SLV PRODUCTIONS’ insurance and full responsibility for all hired goods lies with the hirer.
The Hirer agrees to bear all costs associated with the loss of or damage to any equipment during the hire period. The hirer specifically agrees to:
If any item is deemed damaged beyond economical repair, the Hirer agrees to compensate SLV PRODUCTIONS for the item’s full replacement value based on its condition prior to the damage.
Deposit
If a deposit is required a booking will not be considered confirmed until the deposit is paid.
Cancellation
A minimum of 7 days notice is required for any cancellation. Cancellations made within 7 days of work commencing will incur a 20% cancellation fee. Cancellations made within 48 hours of work commencing will incur a 100% cancellation fee.
Overtime
Should an event extend beyond the scheduled finish time (unless alternative arrangements are made prior to booking) SLV PRODUCTIONS reserves the right to charge for staff overtime.
Late Return
Should equipment be returned after 11am of the specified return date (unless alternative arrangements are made prior to booking) SLV PRODUCTIONS reserves the right to charge an additional day’s rental up to 11am on the following business day.
Weather-Related Risk and Equipment Liability
In the event of adverse weather conditions, if an SLV PRODUCTIONS Technician advises that the event should not proceed due to safety concerns or potential equipment risk, and the client chooses to continue, the client accepts full responsibility and shall be liable for any damage to SLV PRODUCTIONS‘ equipment resulting from weather exposure.
Equipment
SLV PRODUCTIONS is not liable for any issues arising from a customer’s inexperience in operating hired equipment. SLV PRODUCTIONS reserves the right to substitute alternative suitable equipment as required.
Copyright, Performers Rights and APRA Licensing
It is the responsibility of the ‘Hirer’ to ensure compliance with Australian Copyright laws and Performers’ rights, including the acquisition of all necessary APRA licenses.
Payment of Final Invoice
For Dry Hires (hires without a Technician), full payment will be required prior to equipment collection. For hires with technician, a final invoice will be issued shortly after the completion of event/project. The outstanding balance must be paid within 14 days of invoice date.
Failure to make payment may result in the matter being referred to a debt collection agency. Once referred, SLV PRODUCTIONS will no longer have control over the account, and all associated costs – including agency commission, legal fees, and any other expenses – will be the responsibility of the Hirer.
